1. Introduction
These Terms and Conditions ("Terms") govern your use of services provided by K.A.B Fencing ("we", "our", or "us"). By engaging our services or using our website, you agree to be bound by these Terms. Please read them carefully.
2. Services
K.A.B Fencing provides the following services throughout Nottingham and Nottinghamshire:
- Fencing installation, repair, and maintenance
- Landscaping and garden services
- Paving and driveway installation
- Related outdoor construction and maintenance services
All services are subject to availability and our acceptance of your request.
3. Quotations and Estimates
- All quotations are valid for 30 days unless otherwise stated
- Quotations are estimates based on the information provided and site conditions at the time of assessment
- Final costs may vary if site conditions differ from initial assessment or if additional work is required
- We reserve the right to revise quotations if materials costs increase significantly before work commences
- Quotations do not constitute a binding contract until accepted by both parties
4. Acceptance and Contract Formation
A binding contract is formed when:
- You accept our written quotation (verbally, in writing, or by email)
- You pay any required deposit
- We confirm acceptance and schedule the work
5. Payment Terms
Our standard payment terms are as follows:
- Deposit: A deposit of up to 50% may be required before work commences, depending on project size
- Progress Payments: For larger projects, staged payments may be agreed upon
- Final Payment: Balance due upon completion and your satisfaction with the work
- Payment Methods: We accept bank transfer, cash, and card payments
- Late Payment: Interest may be charged on overdue accounts at a rate of 8% per annum above the Bank of England base rate
6. Site Access and Preparation
The customer is responsible for:
- Providing clear and safe access to the work area
- Ensuring adequate parking is available for our vehicles
- Removing any obstructions or items that may hinder work
- Securing pets during our visit
- Obtaining any necessary permissions from landlords or local authorities
- Notifying us of any underground services (gas, water, electricity, cables)
7. Project Timeline
- We will provide estimated completion dates, but these are not guaranteed
- Delays may occur due to weather, material availability, or unforeseen circumstances
- We will notify you promptly of any significant delays
- We are not liable for delays caused by circumstances beyond our reasonable control
8. Variations and Additional Work
Any changes to the agreed scope of work must be confirmed in writing and may result in additional charges. We will provide a revised quotation for any additional work before proceeding.
9. Materials and Workmanship
- We use quality materials suitable for each project
- Materials remain our property until full payment is received
- Natural variations in materials (timber grain, stone color) are normal and not defects
- We reserve the right to substitute equivalent materials if specified items become unavailable
- Customer-supplied materials must be delivered before work commences; we are not responsible for defects in customer-supplied materials
10. Warranties and Guarantees
We warrant that:
- All work will be completed to a professional standard
- Materials used will be fit for purpose
- Workmanship is guaranteed for 12 months from completion date
- Natural material warranties (e.g., timber treatment) are as per manufacturer specifications
Warranties do not cover:
- Normal wear and tear
- Damage caused by misuse, neglect, or third parties
- Natural weathering of materials
- Defects in customer-supplied materials
- Lack of maintenance
- Ground movement or subsidence
11. Cancellation and Refunds
Customer Cancellation:
- You may cancel within 14 days of accepting our quotation (Consumer Contracts Regulations)
- If work has commenced, you will be charged for work completed and materials ordered
- Deposits may be non-refundable if materials have been ordered or scheduled labor cannot be reallocated
- Cancellations must be made in writing
Our Cancellation Rights:
- We may cancel if site conditions make work unsafe or impossible
- We may cancel if you fail to provide necessary access or information
- We may cancel if payment terms are not met
12. Liability and Insurance
- We carry public liability insurance for £5,000,000
- We are not liable for damage to underground services not properly marked or disclosed
- We are not liable for damage to structures not directly part of our work scope
- Our liability is limited to the value of the contract
- We recommend you inform your home insurer of any significant works
13. Complaints and Disputes
If you have any concerns about our work:
- Contact us immediately to discuss the issue
- We will arrange a site visit to assess any defects
- We will rectify genuine defects at no additional cost
- If a dispute cannot be resolved, you may seek mediation or legal advice
14. Health and Safety
- We comply with all relevant health and safety legislation
- Work areas should be kept clear of children and pets during operations
- Customers should not interfere with equipment or materials on site
- We may temporarily restrict access to work areas for safety reasons
15. Waste Disposal
Unless otherwise agreed, we will remove and dispose of waste materials arising from our work. Any pre-existing materials or waste requiring disposal may incur additional charges.
16. Intellectual Property
We may take photographs of completed work for marketing purposes unless you request otherwise. All website content, including text, images, and logos, remains the property of K.A.B Fencing.
17. Data Protection
We process your personal data in accordance with our Privacy Policy. By using our services, you consent to such processing.
18. Force Majeure
We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including severe weather, natural disasters, strikes, or material shortages.
19. Entire Agreement
These Terms, together with our quotation and any written variations, constitute the entire agreement between you and K.A.B Fencing. Any verbal statements or representations do not form part of this agreement unless confirmed in writing.
20. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Existing contracts remain subject to the Terms in effect at the time of agreement.
21. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
